When we talk about Freedom of Speech as it relates to the Public and Private Sector, the following must be understood:
Government Restrictions on Freedom of Speech usually result from:
- Speech that Plans and Encourages Criminal Acts.
- Public Speech that Violates or Intrudes on the Reasonable
Activities of another Individual or Group. In other words; You do not
have the RIGHT TO USE "SPEECH" TO CREATE OR CAUSE A DISTURBANCE
THAT A REASONABLE PERSON WOULD OBJECT TO, GIVEN THE TIME, PLACE
AND CIRCUMSTANCES.
For example: You may have the RIGHT to stand outside your place of business and entice people to
enter, but to walk into anothers place of business and use the same Dialogue would probably be
actionable by the Proprietor against you, either Civally or Criminally.
In another Common Example: Religious Freedom of Speech may allow you limited Solicitation
on a Neighborhood Door-to-Door basis, but you do not have the RIGHT to walk into a Building
conducting Business with the General Public and start Proselytizing. (Unless permitted by Owner,
Operator, or Manager.)
