THE ISRAEL-HAMAS WAR. HOW SHOULD THE NEGOTIATIONS PROCEED?

 

This is from an Article I wrote several years ago Titled: "THE IRAN NUCLEAR TREATY: AVOIDING REALITY."

Given what is going on regarding negotiations between ISRAEL AND HAMAS, I believe there are several points that apply to both. Yes, I realize that one was not done under the influence of an Armed Conflict, but I believe certain Terms and Concepts are common to each.

Now there is a difference between a Treaty and a Truce. I defined Treaty below, and the main difference is:

A Truce is a temporary agreement to cease hostilities for a specific amount of time, or a given geographical area. A Treaty is a permanent set of Guidelines and Obligations that all sides agree to.

 "THE IRAN NUCLEAR TREATY- AVOIDING REALITY." PART 1.

As the Debate over the Nuclear Treaty with Iran is still being Discussed in Congress, and the Media, we find that one thing Remains True:

SOME POLITICIANS STILL AVOID ANY REAL DEBATE THAT MIGHT RESOLVE THE CONTROVERSY.

WHY?  IT WOULD INVOLVE INSIGHT AND THE ABILITY TO THINK BEYOND SIMPLISTIC SOLUTIONS THAT WOULD ADDRESS THE REALITY OF THE SITUATION, RELYING ON MEANINGLESS RHETORIC THAT PLEASES YOUR SUPPORTERS, WHO MAY NOT UNDERSTAND, OR CARE,  ABOUT SOLUTIONS THAT WOULD BENEFIT ALL CONCERNED PARTIES.

So, let us Step Back, Ignore everything that has been said, and look Beyond Bombastic One-Liners to see where the TRUTH MAY LIE.

First Question- WHAT IS A TREATY?

A TREATY IS BASICALLY A CONTRACT BETWEEN TWO OR MORE PARTIES; USUALLY GOVERNMENTS OR NATIONS WHO ARE RECOGNIZED AS THE LEGITIMATE SOURCES OF AUTHORITY FOR A GIVEN GEOGRAPHICAL AREA, OR POPULATION, THAT HAVE THE POWER TO CREATE AND ENFORCE ANY POLICIES, FOREIGN OR DOMESTIC.

A TREATY IS JUST LIKE A SIGNED BUSINESS DEAL. THE GOALS AND PARTIES TO IT MAY BE DIFFERENT, BUT THE PRINCIPLES ARE THE SAME.

What can we Safely Infer if Two or More Parties are Entering into Diplomatic Talks,

with the Outcome Eventually being a SIGNED TREATY FOR ALL PARTIES?

#1-  EACH PARTICIPANT IN THE NEGOTIATIONS HAS SOMETHING THE OTHER WANTS.-  No One Enters into These Negotiations Insisting that the Opposing Side Give Up Something, but will get nothing in return. Turning it around, No Side enters such Talks with the Idea of Giving Into Certain Demands, and Anticipating No Concessions From the Opposition. 

That would be Unrealistic and Foolish.

#2-  WHILE THERE MAY BE MANY POINTS OF CONFLICT OR DISAGREEMENT, ALL PARTICIPANTS HAVE ONE OR TWO MAIN GOALS THEY WANT THE TREATY TO ACHIEVE. These are Usually So Prominent that They are Generally Apparent at the Outset of the Talks, and are in some cases THE ONLY REASON(S) THAT BROUGHT THE OPPOSING SIDES TO THE NEGOTIATION TABLE.

Senate Democrats vote to subpoena Harlan Crow, Leonard Leo in Supreme Court ethics probe as GOP storms out

WASHINGTON − Democrats on the Senate Judiciary Committee voted Thursday to subpoena a wealthy donor and a legal activist with ties to conservative Supreme Court justices after partisan bickering ended with Republicans storming out of the hearing as the final vote was tallied.

Republicans on the panel slammed the move as political theater and accused the 11 Democrats of violating committee rules.

Democrats requested details of gifts, transportation, lodging, travel and private club access provided to justices by billionaire GOP donor Harlan Crow that appear to have been tied in some cases to conservative legal activist Leonard Leo. They moved forward with subpoenas Thursday after concluding neither Crow nor Leo were willing to voluntarily provide the information they had been seeking.

Crow, a Texas-based real estate developer, has been closely linked to Justice Clarence Thomas after news reports showed he had provided the justice with international luxury trips, paid his grand-nephew's private school tuition, and purchased property from Thomas' family. Leo, co-chairman of the Federalist Society, has been instrumental in efforts to elevate conservative judges to the federal courts.

"Senate Judiciary Committee Democrats' goal all along has been to ensure that, like all other federal judges, Supreme Court justices are bound by an enforceable code of conduct," said Sen. Dick Durbin, D-Ill., the committee's chairman.

"Today's vote to issue subpoenas to Harlan Crow and Leonard Leo − two individuals who have refused to comply with this Committee’s legitimate oversight requests for months and are at the center of the Supreme Court’s ethical crisis − furthers that goal," Dubin said.

Of course, the FPA/GOP objected. What do you expect from a Party whose treasonous activities include trying to cancel a Lawful Election, and place a Dictator in the WHITE HOUSE? To them, Hitler and Stalin are heroes, and the Constitution is the enemy- David.

THE FASCIST PARTY OF AMERICA/GOP GESTAPO BRANCH LOSES IN GEORGIA.

 "HOW DARE YOU INDICT TRUMP AND OTHER MEMBERS OF OUR FASCISM FOR ALL PARTY. WHO CARES IF THEY COMMITTED CRIMES: NAZIS, STALINISTS, AND OTHERS LIKE THEM MUST BE LEFT ALONE."

Thankfully, this mindset was defeated in a Georgia Courtroom, where Traitors from the Peach State were  beaten by Legal Minds that have actually Read, Understand, and want to Uphold Constitutional Principles.

THE ISRAEL AND HAMAS WAR; THE QUESTIONS THAT NEED TO BE ASKED. PART 3.

There are Three basic questions that still need to be asked.

- That contrary to what Totalitarian Regimes, Fascists, Anarchists, and wannabe

Dictators around the World had planned and hoped for, a temporary truce showed

that the Nation of Israel and Palestinian authorities could agree to a plan that

encouraged Humanitarian Solutions, and not increase the Body Count.

It worked in the short run. In this spirit, can it can lead to more permanent 

agreements?

- The need to Find and Identify those members of the International Community who could care less

who Wins or Loses, Militarily or Economically, as long as Death and Destruction

continue.

- Who speaks for, and will represent the Palestinian People who are directly affected by

 the conflict.? 

Obviously, and with good reason, the Israeli  Government is going to be very

reluctant to establish permanent Diplomatic Relations with Officials who Planned and/or 

Supported the Initial Attack.

As I said in part 1, I find it hard to believe that either side has benefitted from this 

conflict, especially in the long run. The IDF has expended resources to fight an enemy

they didn't know they had, for the irrationality of attacking a foe that had a clear Military

Advantage made no sense for the Palestinian People of Gaza.

Can both sides find common ground, with;

- The Palestinian People choosing leaders who put them first, not Countries who want 

them used as Cannon Fodder, so they can play the victim card.

- The Israeli Government looking beyond what has occurred and finding Individuals from 

the opposition who see this War for what it is:

A DIRECT ATTEMPT TO CREATE A CONFLICT THAT WOULD DRAG THE

ENTIRE MIDDLE EAST INTO A BLOODBATH, FORCING OTHER NATIONS

TO CHOOSE SIDES. OF COURSE, HOPING THAT THIS INCLUDES THE 

POPULATIONS OF CERTAIN DEMOCRATIC NATIONS HAVING OPEN 

DISAGREEMENTS ABOUT WHICH ETHNIC GROUP, POLITICAL SYSTEM, 

AND/OR RELIGIOUS FAITH TO ENDORSE.

HOWEVER, THIS WAR, TO THOSE WHO TRULY WANTED IT, WAS ABOUT 

ONE THING: TO RETAIN OR ACQUIRE POWER, AND IT WASN'T GOING TO 

HAPPEN THROUGH DEMOCRATIC PRINCIPLES, OR THE WILL OF THE 

PEOPLE. HATE, PREJUDICE, RELIGIOUS BIGOTRY., etc ARE THE SEEDS THAT

WILL SOW THE DESTRUCTION OF FREEDOM FOR ALL OF HUMANITY.
