DISGRACEFUL: NPR COMES TO TRUMPS RESCUE.

It is bad enough that I have to deal with DONALD TRUMPS LIES, OR THE REPUBLICAN PARTIES MARCH TOWARDS FASCISM, BUT LOOKING OUT FOR FAULTY INFORMATION SPREAD BY SO-CALLED "PROGRESSIVES" CAN BE JUST AS DANGEROUS.

Today, NPR CAME OUT WITH THE FOLLOWING:

NPR Poll: Majority Of Americans Believe Trump Encourages Election Interference.

I am not going to reprint it here, even though it was highly critical of DONALD TRUMP, AND THE 

REPUBLICAN PARTY. WHY? BECAUSE IT FEATURED THE FOLLOWING:

"Although there is no evidence that any votes were changed by a foreign power in 2016 or 2018, almost 4 in 10 Americans surveyed said they believe it is likely another country will tamper with the votes cast in 2020 in order to change the result."

THIS IS MISLEADING, AT BEST, AND ATTEMPTS TO SHIELD ELECTION FRAUD IN THE 2016 PRESIDENTIAL ELECTION. HOW?

NO ONE, CERTAINLY NOT ME, EVER CLAIMED ANY VOTES WERE CHANGED BY ANYONE. THE EVIDENCE, AS I HAVE POINTED OUT, TIME AND TIME AGAIN, SUPPORT THE CONCLUSION THAT THE "FINAL TOTALS" WERE ALTERED. THERE WAS NO NEED TO GO IN AND CHANGE INDIVIDUAL BALLOTS.

EVEN THE CLAIM THAT THERE IS  "...no evidence that any votes were changed by a foreign power in 2016 or 2018..." IS MISLEADING. IT DOES NOT ADDRESS DOMESTIC SOURCES INTERFERING IN EITHER ELECTION, NOR DOES IT PRECLUDE FOREIGN ASSISTANCE IN PROVIDING THE NECESSARY INFORMATION TO ACCOMPLISH ELECTION TAMPERING. 

ALSO, NOTICE THAT THEY USE THE TERM "POWER." SINCE "POWER" IS OFTEN USED INTERCHANGEABLY WITH "GOVERNMENT", IT DOES NOT ELIMINATE OTHER FOREIGN SOURCES FROM INTERFERING IN THE 2016 ELECTION. 

(FOR THE RECORD, MY RESEARCH DID NOT INCLUDE THE 2018 ELECTION.)

MAYBE, IF NEWS OUTLETS LIKE NPR HAD BOTHERED TO DO THEIR JOBS, AND ACTUALLY RESEARCHED THE FINAL VOTE TOTALS IN 2016, WE WOULD NOT HAVE A THREE RING CIRCUS IN THE WHITE HOUSE, INSTEAD OF THEM MAKING EXCUSES FOR A DONALD TRUMP ADMINISTRATION.

Today, we all celebrate the life and legacy of one of our country’s greatest citizens: Dr. Martin Luther King Junior. His tireless work toward perfecting our union has inspired millions both in America and across the globe.

He knew that true equality was worth fighting for, but he also knew that it would not be easy. Dr. King gave his life for his fellow man. His struggle was one for equality and peace, built out of passion and love. Even today, Dr. King’s legacy lives on in those people who dedicate their lives to building bigger tables, not erecting walls between us.

The best way to honor Dr. King today is through continuing his fight for freedom and justice. I strive to lead on important issues facing all Texans and Americans, from calling out intolerance in my own community to breaking down age-old divisions and creating a common bond amongst people from all backgrounds.

So, while many of you are enjoying a much deserved day off today, I urge you to take a beat and think about how you can make an impact in your community reflective of Dr. King's vision for America.

THE TRIAL OF TRUMP: JUDGING A JOKE? PART 2.

     ARTICLE 1, SECTION 3, CLAUSE 6.

6: The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

ARTICLE 2, SECTION 4.
The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

SO WHAT CAN WE DERIVE FROM THE CONTENT REFERENCED ABOVE, TAKEN FROM THE BODY OF THE U.S. CONSTITUTION?

DONALD TRUMP WAS NOT CONVICTED OF ANYTHING BY THE HOUSE OF REP. BEING "IMPEACHED" MEANS THAT THERE WAS TANGIBLE AND DEMONSTRABLE EVIDENCE OF WRONGDOING THAT COULD MERIT REMOVAL FROM OFFICE. IT IS THE SENATE THAT "TRIES" ALL "IMPEACHMENTS."

THE "OATH AND AFFIRMATION" TAKEN BY MEMBERS OF THE U.S. SENATE MUST MEAN DIFFERENT THINGS TO DIFFERENT PEOPLE. WHY? IF IT IS DONE TO ENSURE THAT EACH SENATOR SWEARS TO RENDER A FAIR AND JUST VERDICT, ACCORDING TO THE EVIDENCE,THAN HOW DO WE JUSTIFY REPUBLICAN SENATORS SAYING THAT THEY WILL VOTE "NOT GUILTY" BEFORE THE TRIAL HAS EVEN STARTED? IS THIS THEIR DEFINITION OF "DUE PROCESS." IN PRACTICAL TERMS, THEY HAVE VIOLATED THEIR OATH BEFORE ANY TESTIMONY HAS BEEN OFFERED AS EVIDENCE. 

NOTICE THAT THE ONLY TIME THE CHIEF JUSTICE OF THE SUPREME COURT "PRESIDES" OVER AN IMPEACHMENT TRIAL, IS WHEN IT CONCERNS THE POTUS. THIS EXCEPTION MAKES NO SENSE IF IT WAS MEANT TO BE CEREMONIAL IN NATURE, WITH NO REAL POWER OVER THE PROCEEDINGS.

To preside over a court la to “hold” it-to direct control, and govern it as the chief officer. A judge may “preside” whether sitting as a sole judge or as one of several judges. Smith v. People, 47 N. Y. 384.

GIVEN THIS INFORMATION, HOW DOES EITHER THE PROSECUTION OR DEFENSE, IN THE IMPEACHMENT TRIAL OF DONALD TRUMP, HAVE THE FINAL SAY IN:

- HOW EVIDENCE IS PRESENTED.

- THE TYPE OF EVIDENCE THAT 
  CAN BE PRESENTED.

- WHICH WITNESSES CAN BE CALLED,
  OR RECALLED.

IT IS RIDICULOUS TO HAVE THE PROSECUTION, 
OR DEFENSE TEAM, BEING ABLE TO DICTATE 
HOW THE TRIAL WILL BE CONDUCTED.

THAT IS WHY AN IMPARTIAL THIRD PARTY 
MUST BE THE FINAL ARBITER OF WHAT IS
ALLOWED OR DISALLOWED. THAT IS WHAT
THE FRAMERS OF THE CONSTITUTION REALIZED
WHEN THE MOST POWERFUL INDIVIDUAL IN
GOVERNMENT IS BEING ACCUSED OF ACTIVITIES
THAT VIOLATES HIS OATH, AND POSSIBLY
BETRAYS THE COUNTRY HE IS SUPPOSE TO PUT FIRST.
